RELEASE OF LIABILITY AND WAIVER

I release from liability and waive my right to sue the 86 Challenge event organizers and staff, including its sponsors, affiliates, subsidiaries, officers, directors, employees, customers, distributors, independent contractors, suppliers, agents, successors and assigns, (hereafter referred to as ‘86 Challenge’) for any and all claims, including claims of 86 Challenge’s negligence, for any physical injury, illness, death, or economic loss I may suffer or which may result from my participation in 86 Challenge events, travel to and from the events, or any activities incidental to the events.

Participant is fully aware that 86 Challenge and/or its sponsors and event hosts do not cover liability associated with the events. At the event premises and both during and after the event, any injury to, or caused by the Participant will be the Participant’s sole and exclusive responsibility. Participant shall be solely and exclusively responsible for any losses, liabilities, costs, or property damage, personal or private, which the individual may cause during the course of an activity.

Participant agrees to indemnify, defend and hold 86 Challenge harmless from and against all actions, suits, proceedings, judgments, demands, claims, liabilities, losses or expenses whatsoever (including reasonable attorney's fees) incurred in connection with or arising from the 86 Challenge events, the support vehicle(s), the sponsored parts and consumables, the activities or omissions of drivers or team members or the activities or omissions of 86 Challenge including, without limitation:

• Any claim falling within the Participant’s own insurance coverage;
• Any claim or action for or relating to personal loss, injury, death, property damage or otherwise, suffered by participants, competitors (such as the drivers), spectators or other persons at any of the events or team meetings or activities relating to 86 Challenge.

ASSUMPTION OF RISK

I am aware that driving or riding in an automobile or motorcycle on a race track, whether in a race, time trial, or driver education program, for practice, testing, or otherwise, is a hazardous activity involving a high-degree of risk of serious injury or death. I am voluntarily participating in such activities with knowledge of the danger involved and hereby agree to assume any and all risks of injury or death resulting from this activity.

PHOTOGRAPHY AND MEDIA RELEASE

I grant to 86 Challenge all rights and permission to use my name, likeness, image, or any and all photos, videos, or audio recordings of me while participating in an 86 Challenge event or related activities.

86 Challenge has the right to use or publish them in whole or in part, individually or in connection with other material, in any and all media now or hereafter known, including the internet, and for any purpose whatsoever, specifically including illustration, promotion, art, editorial, advertising, and trade, without restriction as to alteration. I waive any right to royalties or other compensation arising from or related to the use of these materials. I release and discharge 86 Challenge from any and all claims and demands that may arise out of or in connection with the use of the photographs or recordings, including without limitation any and all claims for libel or violation of any right of publicity or privacy.

This authorization and release shall also extend to the benefit of the heirs, legal representatives, licensees, agents and assigns of the 86 Challenge as well as the person(s) who took the photographs or recordings.

This release is intended to be as broad and inclusive as permitted under California law. If any portion of this release is held invalid, it is agreed that the balance of the release shall continue in force and effect.

I am a legally competent adult and have the right to contract in my own name. I have read this document and fully understand its contents. This release shall be binding upon me and my heirs, legal representatives, and assigns.
